Terms and Conditions

1. Acceptance of terms

By accessing or using favpik.com (the "Platform"), operated by FavPik ("we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, Cookie Policy, and Poll Creation Guidelines. If you do not agree to these Terms, you must not use the Platform.

We reserve the right to modify these Terms at any time. Changes take effect upon posting. Your continued use of the Platform after any modifications constitutes acceptance of the revised Terms.

2. Eligibility

You must be at least 13 years of age to use the Platform. If you are between 13 and 18, you must have parental or guardian consent. By using the Platform, you represent and warrant that you meet these eligibility requirements.

3. Account registration

Certain features (such as creating polls) require account registration. When creating an account, you agree to: provide accurate, current, and complete information, maintain the security of your account credentials, accept responsibility for all activity under your account, and notify us immediately of any unauthorised access at hello [at] favpik [dot] com.

We reserve the right to suspend or terminate accounts that violate these Terms, our Poll Creation Guidelines, or applicable law.

4. Platform services

FavPik provides a polling platform where users can vote on curated polls and create their own decision-making polls. The Platform is provided "as is" and "as available." We do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue any part of the Platform at any time without prior notice.

5. User-created polls

When you create a poll on FavPik, you agree to comply with our Poll Creation Guidelines in full. You retain ownership of the content you create, but you grant FavPik a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote your poll within the Platform and related marketing materials.

User-created polls are private by default — they do not appear on FavPik's main pages, search, or category listings. They are accessible only via their unique share link. We reserve the right to remove any user-created poll at any time, without notice, for any reason, including but not limited to violation of these Terms or our Guidelines.

6. Voting and poll integrity

Each user is permitted one vote per poll. We use browser fingerprinting, IP analysis, and reCAPTCHA to prevent duplicate and fraudulent voting. Any attempt to manipulate poll results through bots, multiple accounts, coordinated voting, or any other means is strictly prohibited and will result in immediate account termination and potential legal action.

Poll results are provided for informational and entertainment purposes only. FavPik does not guarantee the accuracy, completeness, or reliability of any poll results and is not responsible for decisions made based on poll outcomes.

7. Prohibited conduct

You agree not to: use the Platform for any unlawful purpose, attempt to bypass security measures, voting restrictions, or rate limits, impersonate any person or entity, upload malicious code, viruses, or harmful content, scrape, harvest, or extract data from the Platform without permission, use the Platform to send spam, unsolicited messages, or advertisements, interfere with the Platform's operation or other users' experience, or create polls that violate our Poll Creation Guidelines.

8. Intellectual property

All content on the Platform — including but not limited to the design, logo, text, graphics, software, and curated poll content — is the property of FavPik or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent.

The FavPik name, logo, and brand elements are trademarks of FavPik. Unauthorised use of our trademarks is strictly prohibited.

9. Third-party services

The Platform uses third-party services including Vercel (hosting), Neon (database), Resend (email), Anthropic (AI moderation), Google reCAPTCHA (bot protection), and FingerprintJS (duplicate prevention). Your use of the Platform is also subject to the terms and privacy policies of these providers. We are not responsible for third-party service outages, data practices, or policies.

10. Disclaimer of warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAVPIK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, REGARDLESS OF THE THEORY OF LIABILITY.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR INR 1,000 (INDIAN RUPEES ONE THOUSAND), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless FavPik and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with: your use of the Platform, your violation of these Terms, your violation of any third-party rights, or any content you create or submit on the Platform.

13. Governing law and disputes

These Terms are governed by and construed in accordance with the laws of India. Any dispute arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts in Goa, India.

Before initiating any legal proceedings, you agree to attempt to resolve disputes informally by contacting us at hello [at] favpik [dot] com. We will attempt to resolve the dispute within 30 days.

14. Termination

We may terminate or suspend your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination will survive, including but not limited to intellectual property rights, disclaimers, indemnification, and limitations of liability.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
